5. The Third Surveyors can also be called upon by either Building Owner or Adjoining Owner, if they don't agree with their Surveyor.

6. Compared to the situation where there is only one Agreed Surveyor. There's no second Adjoining Owner Surveyor checking the Building Owners Surveyor's work. Adjoining Owners have no recourse to The Third Surveyor. The only time where the Owners can challenge the Agreed Surveyors decision is to Appeal the Award in Court. There's a time Limit of 14 days to appeal the Award from the date it's served and there will be court costs involved.

4. The 10-4 Rule – Explained for Adjoining Owners

- “If you fail to Appoint a Party Wall Surveyor - One may be appointed on your behalf”

- Or Worse You may end up with NO Party Wall Surveyor !!!

1. What is the 10(4) rule ? – 14 days after sending the Adjoining Party Wall Notices. The next step of the process is to send a reminder letter know as the 10(4) Letter, giving the Adjoining Owner a further 10 days to reply. After this period The Building Owner should appoint a Surveyor on the Adjoining Owners behalf. The appointed Building Owner Surveyor can NOT be appointed as an Agreed Surveyor under the 10-4 process.

2. Why ? – it's original purposes – to keep the process moving and also ensure the Adjoining Owner has an independent Party Wall Surveyor.

3. Building Owners requirements – where the Adjoining Owner fails to respond to the 10-4 Letter – the Building Owner is required to Appoint a Party Wall Surveyor on their behalf.

4. There are strict time deadlines. After the 10-4 reminder Letter time lapses the Building Owner should appoint a Surveyor on your behalf.

5. As your Adjoining Owner Surveyors we welcome and value your input to protect your property.

6. The Fees for appointing us as Adjoining Owner Surveyor will usually be paid by the Building Owner therefore you may as well engage in of the situation in order to protect your property.

6. How to Protection from Current and Future Structural Damage

Below are how to Protect your property from Current and Future Structural Damage

1. Once appointed as Adjoining Owner Surveyor we check to see if the proposed works are allowable under the Act.

2. Ask for details of how the works will be carried out (Method Statements).

3. Ask for Security for expenses where this is appropriate.

4. Check/Oversee the Schedule of Condition. This is important as it's used as a baseline in the future, if damage occurs whether it's structural or decorative.

5. The main tool for dispute resolution is the Award. In the Award amongst other items contains the process for how damage will be handled.

6. Adjoining Owners have the right to choose if they let the Building Owners builder fix damage or receive payment in lieu.

7. The Award stays “live” forever – if damage is uncovered in the future, the current Building Owners will still be liable – a classic example is where wardrobes are removed at a later date and damage is discovered.

8. Protection Against future maintenance problems due to bad designs – Gutter placement is most common example bad design that's likely to cause future.

7. Help you Receive Money Which may be due to you 

1. Section 11(11) of the Party Wall Act entitles Adjoining Owners to receive monies for Walls built by the Adjoining Owner which are used by The Building Owner as part of the building project.

2. The amount of monies due are calculated by Building Owner's Surveyor and checked by the Adjoining Owner's Surveyor.

3. This may not be a priority for the Building Owner/Agreed Surveyor. Occasionally, the Building Owner's Surveyor may need to be reminded.

4. On every single Adjoining appointment we check to see if “Enclosure Costs” are due.

5. You actually don't need to do anything in order to receive any monies due. This is in effect free money.

6. We manage this Process for you as part of our of Role, on every appointment.

7. Adjoining owners have the right to choose if they let the Building Owners builder fix damage or receive payment in lieu. It may be better to receive monies rather then get the builders to fix the damage. Especially, where other works are preplanned in that part of the property. The amount of compensation is determined by the Surveyors.

8 Adjoining Owner Check List – Top 20 Issues – (Private & Confidential)

The following list is a Private and Confidential checklist of Top Issues we check on behalf of Adjoining Owners. This is an example of some of the things we check on your behalf.
